The employment contract is as important for you as it is for the employer, as it defines the rights and obligations of each party. Contributions are made for social insurance in case of unemployment (Arbeitslosenversicherung), pension insurance (Rentenversicherung), long-term care insurance (Pflegeversicherung) and in case of illness (Krankenversicherung).
We know that sometimes it is difficult to understand the content of such an agreement, so before signing it, we will go through each point of the agreement with you and answer your questions so that you have a good understanding of what it includes.
Information that must be included in the employment contract:
- Names and addresses of both parties of the contract
- Date of beginning of employment contract
- In the case of fixed-term contracts: the expected duration of the employment relationship
- Place of work
- A brief description of the employee's duties
- The components and amount of the labor remuneration, including any allowances, bonuses and financial bonuses, as well as the dates on which they are paid
- The agreed working hours and working time system
- The number of vacation days
- The period of notice of termination of the employment contract
- A general reference to collective labor agreements or company agreements
- The scope of the employment contract
The specific form of the employment contract and the language contained within should always be tailored to the particular case. The question of how extensive the employment contract will be will depend, among other things, on the type of work being contracted. In the employment contract, a probationary period is often agreed upon, which makes it easier for both parties to terminate the employment contract. The trial period is six months.
During the first four weeks of the trial period, the contract may be terminated with two working days' notice.
From the fifth week to the end of the second month of the contract, notice is one week.
From the third to the sixth month, the contract can be terminated with two weeks' notice.
Over six months, the notice period is one month.
